The owner of a sports gun that was used in a shooting that killed three people in Texas may have had access to the weapon, according to investigators.
The owner of the .22 caliber rifle, which was purchased in 2014 and used in the shooting, has been identified as James M. McDaniel, a retired police officer from Houston.
The incident occurred at a house in the small town of Del Rio on July 3, when McDaniel fired a single shot into a wall and hit his wife and daughter.
The woman who was hit died from her injuries.
The shooting took place on the same day that a new sheriff was elected.
McDaniel has been arrested twice in the past on drug and gun charges.
Last year, he pleaded guilty to aggravated assault and was sentenced to probation.
McKaye Police Chief John McAdams said Tuesday that the police department has spoken with the McDaniel family, and that a criminal investigation is underway.
The department also has a warrant out for his arrest.
“We’ve had several conversations with the family about that, and we’re working on that,” McAdams told reporters.
“We’ll continue to do that.”
A spokesman for the state Bureau of Criminal Apprehension declined to comment on the McDavis, saying the agency was still reviewing the case.
McDaniel’s attorney, John McDaniel Jr., said in a statement that the family is cooperating with police.
The shooting was reported to the sheriff’s office at about 5:20 a.m. when police were called to a home in Del Rio, about 60 miles southeast of Houston, for a domestic disturbance.
Investigators determined that the shooting was accidental, McAdams reported.
“This is a terrible tragedy,” said Del Rio Mayor Paul R. Gaviria.
“The McDavises are very much loved in this community.
They were dedicated to serving our community.”
